I understand there will be stress headache etc... I just wanted to see if the cost of appealing a wrongly rejected 485 was something a H1b employee can afford.
BTW on lighter note:
For headache I use zandu balm
and for stress I do Yoga.
These dont cost as much as docs/lawyers in this country!!

Hi,
I came to US on L1 Visa and later applied for COS to H1 last year. I work for consulting company. My client wants me to travel to Nigeria for 3-4 weeks for project implementation. I would like to if I can get my H1 Visa stamping there. Will there be any issues in getting the stamping and should I need to do any legal preparation for the same ?
I would like to hear advice from seniors and anyone who has faced similar situation.

I'm facing a frustrating issue and am hoping that someone can provide help on this. I'm on my H1 10th year extn. My I-140 (EB-3) was recently approved and I cannot apply for I-485 as the visa dates are not available. My Company recently changed their name from ABC, doing business as XYZ, to DEF, doing business as XYZ (the doing business as part of the name is the same and there was no merger, just a name change).
My first question is does this invalidate my approved I-140 and should I refile the I-140. Also, when I file my H-1 extension what document should I provide to prove the name change (or is it even needed?)? Any help on these 2 questions would be greatly appreciated. Thanks.

HR of my Company screwed up with the content of the EB2 Ad posted in sunday newspaper. To save money they posted a partial AD with a link to the job listing on the companys website saying "Please goto this link for further information".....
Would this be ok?
If the company is paying the lawyer for the process, you just relax. They must have consulted the lawer before giving the ad and get directions, because the lawyer has to send these evidences when filing.
If not, you better check with an expert.

If you are on H-1, you cannot apply for L-1. You would have to work for a company outside the US for a period of 1 year before you can apply for a L-1 assuming you are in the US currently.

I have applied for my wife's AP with NSC today and She needs to travel on April 3rd. I wanted to know how long does it take these days for approval?
Also, if she does not get the AP by April 3rd she would be travelling anyway. Because, I can mail her the AP once we receive even after her departure as I am going to be here in US. My question is if she travels out of the country before the approval, would USCIS know about it and would it affect her application? And if it does not come at all, can she apply for H4 stamping in India and come back on it? Please let me know guys.

The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2010 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States.
Winners should start finding out very soon. Notifications to the randomly-selected diversity visa or "green card lottery" winners are being sent between May and July 2010.
How does it all work?
Soon an official letter from the U.S. Department of State Kentucky Consular Center (KCC) in Williamsburg, Kentucky will be sent to the mailing address that you provided in your entry. Being selected as a lottery winner does not guarantee that you will receive a visa; you must still apply and qualify for the immigrant visa. Received my REF last month then i sent my reply and they received it. Now everytime i checked the online status the Update Date in the online account is changing everyday for last couple of days. What does it mean? Is it a positive sign or not? kinda worried about the whole situation. Please let me know what you guys think or anyone get this kind of update or not?

On month xx, xxxx, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

When i travelled using AP i had Just One copy and when IO asked for rest i said they are with the attorney.
The IO said i should carry all AP copies and can reuse the one which is stamped.
