    Well, that is certainly frustrating! Your best option would be to get in touch with the designated Application Support Center to see if they can either notify the USCIS Service center of the error or have your daughter come in right away for fingerprinting. ASC phone numbers are generally not made public, but in many locations, ASC staff has provided local immigration attorneys with a phone number to use for urgent or unusual situations such as yours.
    If you don't have an attorney who can call the ASC for you, you might consider just going to the ASC in person with your daughter to explain the situation and ask for their assistance.

    Thanks for your response. I did check the extension form many times and also reviewed it from another person. Because of their same last name and similar first name we all missed the mistake. We took an infopass appointment for tomorrow. Also we did go to CBP but they told us to file I 102 for my mother-in-law to get new I-94. Also I think I have to send the my father-in-law's I-94 to the following address for correction

    Unfortunately now my mother-in-law has to go back early.
    One thing I learned it to always check the full content of the I-94 after arrival.

    I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.

    I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.

    My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?

    Please help....Thank you

    Aliens who married or had children before the date of obtaining permanent residency can possibly confer �following-to-join� benefits to their family members. Due to this process, spouses and children will be able to receive green cards quickly. �Following-to join� is not family based immigration, but is similar to a child/spouse receiving derivative benefits based on a primary LPR�s immigration petition.

    Here are the following requirements to be met in order for a spouse or child to qualify under �following-to-join�:
    1. The LPR must have adjusted status or obtained an immigrant visa through a preference category (family or employment based) or diversity lottery. A LPR�s visa number must also be current in order for a family member to receive �following-to-join�.

    2. The petitioner married/had children before becoming a permanent resident and the relationship between the permanent resident and spouse/child is intact at the time of filing. Children of LPRs must be unmarried and under the age of 21. Furthermore, the child/step-child must be from an existing marriage before the LPR obtained permanent residency.

    �Following-to-join� is convenient because it allows primary beneficiaries to do away with filing a separate I-130 for their spouse or child, greatly expediting the green card approval process. Furthermore, spouses and children of LPRs do not have to wait for a visa number to become available. Where a LPR�s spouse or child currently resides affects what procedures he/she needs to follow. If ones spouse and/or child are already in the United States, they may apply for adjustment of status (I-485) based on �following-to-join� and if they are outside of the United States then LPRs need to inform a U.S. consulate of their lawful permanent residency status in order for their family members to apply for an immigrant visa.

    There is a policy for accepting asylees from Cuba and allowing them to seek permenant residency.

    The wet feet, dry feet policy (sometimes called the wet-foot, dry-foot Policy) is the name given to a consequence of the 1995 revision of the Cuban Adjustment Act of 1966 that says, essentially, that anyone who fled Cuba and got into the United States would be allowed to pursue residency a year later. After talks with the Cuban government, the Clinton administration came to an agreement with Cuba that it would stop admitting people found at sea. Since then, in what has become known as the "wet feet, dry feet" policy, a Cuban caught on the waters between the two nations, "wet feet", would summarily be sent home or to a third country. One who makes it to shore, "dry feet", gets a chance to remain in the United States, and later would qualify for U.S. citizenship.


    You better carry a nice towel with you when you come back from Cuba and make sure your feet are dry when apprehended by coast guard. And make sure you dont end up getting kidnapped and killed in Cuba, coz they really dont have very nice law enforcement.

    My interview went fine. I got the H1 stamping done today at hyd counselate. The interview was pretty short. I showed him all the important certificates ( Passport + petition + Hdfc fee slip + DS forms ). Then he asked me the following questions:
    Why do I want to go to US?
    where I am working?
    How long have I been working?
    What do I do in my job?

    APPROVED!

    This is my number -- **********. If u have any question give me a call. This number is valid till april10th... after that I will be in US.

    My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.
