Hi All,
Need some piece of advice. My H1B is expiring on 07-15-08, On July 2nd my I-140 was filed in premium processing. My LC is not 365 days old, so i need I-140 to apply for 3 year extension of my H1. Since it takes max of 15 calander days for I-140 to go through it may protentially get approved on July 18th and the approval may arrive in a week after that. Since I dont have a basis for requesting H1 extension , I am wondering how I can stay in status from 15th July till i get I-140 approved.
Any ideas?

I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

L-1 petition is non-transferable and tied to employer A. However, employer B can file H-1 for you.

Many desi companies apply for EB visas for folks still in India and have them work in India, till the CP stage..

From your post it is not clear if your 140 is already approved or pending.
Anyhow, assuming it is approved and he cancels, then an RFE is bound to come, it is best to file for AC21 with new employer, since RFE could also involve EVL with recent paystubs................. now since in your case even your new job is with a consulting company (do not know how big it is), you might get stuck with RFE too.

Hi,
I was on H1 before and my I797 form says my h1 is good till 082011. And in June my employer terminated my employment. Within a month I changed my status to H4 and got my H4 visa stamped from India. Now I got a project and my employer re hired me and started my h1 processing (regular). And my client gave the start date from Dec 14th.
My employer is saying that you can work from Dec 14th however once you get an approval you have to leave and comeback with H1 stamp on it.
They said that we have done these situations before and I also contacted one of the person and she was saying that she started working once h1 filed then she immediately left to India to get stamped (She also said they is an option to get it stamped in Canada as well).
Now is this true? My GC process currently waiting for the date (EB2-I140 APPROVED). Does this affect my GC in future?
I told my employer( it's a big reputed company) and they are saying that we will ever do anything illegal, if it is illegal then we won't even consider that option so you are fine don't worry and our immigration lawyers are very experienced so you have understand and trust us. This is what they are saying.
Whom to believe? What is right? what is wrong? Please understand my confused situation. I am going through lot of stress right now because of this.

What I understand is that, your spouse can apply for H1, but not "change of status" while on EAD/adjustee. The establishment of H1 status for your spouse is possible only via an entry using H1 visa.
So your spouse can wait in USA for the H1 approval notice and then travel outside USA for consular processing.
Anyway, it may not worth all this pain, since she can continue using EAD.

Could you please pm us the IP address of your machine. It will help us to diagnose the problem and/or let you know the reason. Its possible that your work environment is using NATing. So all machines from within that network will propagate the same external IP address. If you could send us your IP address at work, we will be able to diagnose the problem.

My parents are planning to go for a visa interview. What is difference between me inviting them to visit me versus they applying as tourists. I understand that if they apply as tourists they need to provide documents showing that they can support themselves.
Will coming as a tourist diminish the possibility of getting 10 year multiple entry visa. Any thoughts on this issue is much appreciated.

NO, IT SHOULD HAVE NO EFFECT. THE 180 DAY RULE IS MORE RELEVANT AFTER YOU BECOME A PERMANENT RESIDENT. IN THAT CASE IT IS BETTER NOR TO STAY OUTSIDE THE US FOR 180 DAYS.

If your company pays for there own lawyer then go ahead and change it to new one. As the response from lawyers will be fast. And you can avoid big expenses if you retain earlier law firm. Keep in mind Lawyers charge for each and every thing they do.
I did this and recently gave G28 for new lawyers. (But when my H1 was transfered new company lawyers goofed up the office address and I have not yet received I797 any how this is a different story. Planning to apply for a copy)
Why I am reluctant to go with new guy is due to EVL content.
Old guy knows abt the case and prepare the letter accordingly.
My concern is...if I retain old guy... Is it legal to pay expenses from my pocket?

i'm above 21yrs old and on f1 status ..my question is
My sister is citizen here and can file family based GC (to get it would take 10yrs miin)
1)for me to maintain legal status i have to move into h1 status later on..will the Family GC process affect in any way to get h1 later on?
2)Do i have a chance to file GC later on under EB2,or are 2 GC applications not accepted(just curious)
Please post your thoughts attorneys
